Supreme Court Will Hear Travel Ban Case this Fall

The U.S. Supreme Court announced today that it will hear the Trump Administration’s request to review recent federal court decisions blocking the President’s revised executive order (“travel ban”) issued in March, which limited travel for nationals of six Muslim-majority countries (Libya, Iran, Somalia, Sudan, Syria, and Yemen) for a 90-day period. The revised executive order to be reviewed does allow travelers from those nations with valid green cards and visas to continue to enter the U.S. uninterrupted.

The Court will hear arguments for the case this fall and will render a decision on the President’s powers in immigration matters, as well as the constitutionality of the travel ban, at that time. Most importantly, until that time, the Court has lifted the hold put on the travel ban by the lower courts and stated that a limited version of the travel ban can remain in place until a decision is made this fall. The limitation noted by the Supreme Court is that the ban “may not be enforced against foreign nationals who have a credible claim of a bona fide relationship with a person or entity in the United States.”

The travel ban is expected to be placed back into effect, with the Supreme Court’s noted limitation, this week. It is likely that the Supreme Court’s review of the travel ban this fall could be considered a moot point since the 90-day travel ban period will have already passed by the time that the Court hears the case.
